If I am partially at fault, do I still have a claim?

If you are partially at fault for your own injuries, a judge or jury will determine the degree or percentage of each party’s negligence and will apportion damages according to the percentage of fault assigned to each party. This is called “comparative negligence” and it is the method by which damages are apportioned in California. Comparative negligence is discussed in further detail below.
